Η μετανάστευση τον καιρό του COVID-19 με την Kerstin Bree Carlson

Η Kerstin είναι καθηγήτρια Διεθνούς Δημοσίου Δικαίου στο Παν/μιο Νότιας Δανίας και στο Αμερικανικό Πανεπιστήμιο του Παρισιού. Η έρευνα της εστιάζει στα Διεθνή Ποινικά Δικαστήρια, και τη χρήση του νόμου στην αναζήτηση μεταβατικής δικαιοσύνης και συμβιβασμών μετά από συρράξεις.

Έχει συγγράψει βιβλία και άρθρα για το θέμα, μεταξύ των οποίων τα “Model(ing) Justice: Perfecting the Promise of International Criminal Law” (2018) –σχετικά με το δόγμα και τον αντίκτυπο του Διεθνούς Ποινικού Δικαστηρίου για την πρώην Γιουγκοσλαβία-,  “The President on Trial: Prosecuting Hissène Habré” (με τις Sharon Weill και Kim Thuy Seelinger, 2020) –μια εξέταση της υβριδικής δίκης στη Σενεγάλη, με κατηγορούμενο τον πρόεδρο του Τσαντ, Χισέν Χαμπρέ-, “The Justice Laboratory: Internationalizing Law in Africa” (υπό έκδοση, 2020) –μια επισκόπηση διαφόρων υπερεθνικών δικαστηρίων που απασχολούνται με υποθέσεις από την Αφρική.

Στην  ομιλία της για τη σειρά Corona flowers αναφέρεται στη μετανάστευση στο Αιγαίο κατά τη διάρκεια της πανδημίας. Από κοινού με Έλληνες συνεργάτες, η Kerstin προσπαθεί να φανταστεί τρόπους που ο νόμος θα μπορούσε να εμπλακεί στην καταπολέμηση των παραβιάσεων των Ανθρωπίνων Δικαιωμάτων που συνοδεύουν την παράτυπη μετανάστευση. Η ομιλία επικεντρώνεται στις ιδέες της Kerstin για την παρέμβαση του Διεθνούς Ποινικού Δικαίου ως μηχανισμού αντιμετώπισης της αθλιότητας που υφίστανται οι παράτυποι μετανάστες και οι παράτυπες μετανάστριες. Εκτός των παρεμβάσεων στη χάραξη πολιτικής, ο νόμος διατηρεί επίσης την ελπίδα για την αναδιαμόρφωση του κυρίαρχου αφηγήματος για τους μετανάστες και μετανάστριες και το φαινόμενο της μετανάστευσης, κάτι που μπορεί να έχει εξίσου σημαντικά πολιτικά επακόλουθα.

Migration in the time of COVID-19 with Kerstin Bree Carlson

Kerstin is a professor of international public law at the University of Southern Denmark and The American University of Paris. Her research focuses on international criminal tribunals and the use of law in pursuing transitional justice and post-conflict reconciliation.

She has written several books and articles on the topic, including Model(ing) Justice: Perfecting the Promise of International Criminal Law (2018) [considering the doctrine and impact of the International Criminal Tribunal for the former Yugoslavia]; The President on Trial: Prosecuting Hissène Habré (with Sharon Weill and Kim Thuy Seelinger, 2020) [reviewing the hybrid tribunal in Senegal for Chadian president Habré]; The Justice Laboratory: Internationalizing Law in Africa (forthcoming 2020) [reviewing several different supranational courts working on African cases].

 

Her talk for Corona flowers considers migration in the Aegean during the pandemic. In collaboration with Greek partners, Kerstin is trying to imagine a way that law can be engaged to fight the human rights abuses that accompany irregular migration. This talk focuses on Kerstins ideas for the use of international criminal law to serve as a mechanism for addressing the misery irregular migrants suffer. Beyond the policy-related changes that law might be able to enact, law also holds the promise of altering the narrative obtaining around migrants and migration, which can have important political ramifications as well.
